Summary
The U.S. Department of Education’s Office for Civil Rights (OCR) has concluded that a Colorado school district, Jefferson County Public Schools, violated federal civil rights law by allowing male students to access female bathrooms, locker rooms, and overnight accommodations, and to compete in girls’ sports. The OCR found that the district’s policies deny girls “safety, dignity, and equal access” to educational programs and activities. The district has been given 10 days to voluntarily comply with a proposed resolution agreement or face potential federal enforcement action.
Our Reading
The game followed a familiar script.
Another school district gets caught allowing boys to play girls’ sports, and suddenly everyone’s an expert on Title IX.
The OCR received athletic rosters from Jefferson County Public Schools, and the rosters indicate “male students may occupy up to 61 roster positions on girls’ sports teams in the district.”
Because of course they did.
This one felt recognizable early.
This thing is going to get played out in court for years, and still, we’ll see parents and athletes on both sides saying the same tired things.
The result wasn’t surprising by the end.
This is how it always goes – schools try to push the boundaries, and eventually, someone blows the whistle and the OCR gets involved.
This is just the latest chapter in the ongoing saga of who gets to play what sport, and who gets to use which bathroom.
Original observation: The investigation began in June 2025, when OCR launched a probe into allegations that Jefferson County Public Schools had removed safeguards requiring single-sex overnight accommodations on district-sponsored trips.
